What Is the Definition of Drunk Driving in Arizona?

A person is considered to be under the influence, whether the substance is alcohol or drugs, when “his or her ability to drive safely was affected to an appreciable degree.” In Arizona, this translates specifically to a blood alcohol concentration of 0.08% or more. A BAC of 0.15% or higher constitutes extreme DUI.

Comparing Buzzed Driving to Drunk Driving

With a legal limit of 0.08%, it’s clear that at this point in time Arizona does not prohibit drinking and driving under all circumstances. So you’ve had only a beer or two and you’re feeling a pleasant but light “buzz.” How do you know whether or not you’re within the acceptable limit?

It’s certainly possible to for someone to be capable of driving safely after a drink or two. The problem is that you can’t judge your BAC simply by how you feel. Your BAC can rise higher than normal if:

  • You are a less-than-average weight
  • You haven’t eaten in several hours
  • You’re taking medication, either prescription or over-the-counter

In addition, you can still be charged with a DUI if you’re under the legal limit but you were driving in an unsafe manner according to the judgment of the arresting officer or the court.
