CASE DISMISSALS
TYPE OF CASE: Leaving the scene of an accident
OUTCOME: Case dismissed
DETAILS: Client was charged in the Downtown Justice Court with leaving the scene of an accident, a criminal traffic offense. On the date of offense, the client was involved in an accident with another vehicle on the I-10 freeway, and after the collision he left the scene without contacting the other driver or notifying police. Our Phoenix criminal attorney was able to negotiate a complete dismissal of the case!
TYPE OF CASE: Massage facility violation
OUTCOME: Case dismissed
DETAILS: Client was a licensed massage therapist in the city of Scottsdale. On the alleged date of offense, Scottsdale Police Officers showed up at her place of business to conduct a routine massage facility inspection. Police then cited the client for a violation of the Scottsdale City Code governing massage parlors, a class 1 misdemeanor. Our criminal lawyer in Scottsdale argued the complaint was insufficient as a matter of law and threatened to file a motion to dismiss. A couple days later the prosecutor dismissed the case.
TYPE OF CASE: Theft by extortion
OUTCOME: Felony dismissed
DETAILS: This client had an interesting case. The client allegedly called a grocery store and threatened corrective action if a specific employee wasn’t terminated. The case was investigated as “making a terroristic threat,” but later charged as theft by extortion. Our criminal lawyer was confident the state couldn’t make its case for probable cause, and set the matter for a preliminary hearing. The state dismissed the case the next day.
TYPE OF CASE: Criminal damage / Domestic violence
OUTCOME: Case dismissed at trial
DETAILS: Phoenix Police responded to a domestic violence call from client’s girlfriend who stated she had an argument with our client and the client punched the wall causing a sizable hole. Client was arrested and charged with criminal damage. Our criminal lawyer in Phoenix set the case for a bench trial and the prosecution ultimately dismissed the case.

DETAILS: Client was charged with assault in the North Valley Justice Court after having an argument with her husband. The allegation was the client repeatedly struck her husband on his back and shoulders. DETAILS: Most people are unaware it’s a crime to possess glass bottles within certain parks or in areas around lakes. Our client was one of those people. He was contacted by police near a lake when responding to a noise complaint. The client was holding a beer bottle when police arrived, and had several more in the back of his vehicle. Our criminal lawyer negotiated a resolution where our client could do community service in exchange for a dismissal of the criminal charge.

OUTCOME: Case dismissed
DETAILS: Client was arrested by Glendale Police for disorderly conduct following an argument he had with his girlfriend. The couple quarreled over finances and the police were called. A citation was issued for disorderly conduct in the Glendale City Court. Shortly we after our criminal lawyer filed his notice of appearance in the case the prosecutor dismissed the charge.
TYPE OF CASE: Criminal damage
OUTCOME: Case dismissed
DETAILS: In the Tucson City Court, our client was charged with criminal damage following allegations he attempted to break into the office building of his employer. The business had active surveillance cameras and alarms. The suspects were caught on video, and our criminal defense attorney was able to argue issues related to the surveillance video and the ability to use it identify our client as the perpetrator. Ultimately, after our attorney stated he was ready to set the case to trial, the prosecutor dismissed.

DETAILS: Client was charged in the Phoenix Municipal Court with assault. Our criminal lawyer set the case to trial, and on the day of trial the state dismissed.

DETAILS: Client was charged with possession of dangerous drugs and possession of drug paraphernalia in the Maricopa County Superior Court. Due to her criminal history, the state made a plea offer that required a minimum of one year in the Arizona Department of Corrections. OUTCOME: Case dismissed
DETAILS: Unbeknownst to the client, he was charged with misdemeanor theft offenses in 2012, which was first discovered when his employer ran a background check in 2019. His criminal lawyer with the Lerner and Rowe Law Group was able to argue to the prosecutor this was a case of mistaken identity and that someone else had used our client’s information when contacted by law enforcement to avoid detection. Case dismissed!
