When can baked goods cause you trouble?

Ah, the joys of giving homemade baked treats during the holidays. There’s nothing that imparts the joy of the season quite so well. But lest you think you can impart a little extra “joy” in the form of specially enhanced treats infused with cannabis goodness, think again.

Medical Marijuana Is Legal, Except When It’s Not

You can’t share it with anyone but another patient.

In 2010, Arizona passed the Medical Marijuana Act. This allows people to use no more than 2.5 ounces of medical marijuana every two weeks. In 2016, Arizona voters rejected Proposition 205, which would have allowed the recreational use of marijuana for people 21 and over.

As such, Arizona’s current drug laws strictly forbid the sale of marijuana except for medically prescribed purposes. Which means that you may not distribute it in any fashion (including baked treats) except with another medical marijuana patient.

Accidental overdoses can be dangerous to everyone.

Not all edibles are the same and not not everyone reacts to the same. Two examples:

  1. A Colorado man is now sentenced to 30 years for killing his wife while high on (legal) marijuana candy. Richard Kirk shot his wife on April 14, 2014. She was on the phone with 911 operators when it happened; saying that she was scared because her husband seemed “drunk” and opening their gun safe. The youngest of their three children, 7, witnessed the shooting.
  2. When an 11-month-old child died suddenly at a poison control center in Colorado his cause of death was listed as myocarditis, or inflammation of his heart muscle. However, the doctors who took care of him at the center found high concentrations of marijuana in his blood. The doctors believe the child accidentally ingested or inhaled quantities of marijuana or its smoke.
    They also believe those high concentrations to be the cause for the heart damage and ultimately, the child’s death. Some research has shown that abuse of cannabis can lead to myocarditis, as well.

Driving after eating a “baked” edible can result in a Marijuana DUI.

Another thing to keep in mind: if you indulge in a marijuana edible and drive, you could receive a DUI. In Arizona, it is a class 1 misdemeanor to drive while impaired by marijuana or to drive while marijuana’s active metabolite is in your system; even if it has been a while since ingesting the marijuana.  For Medical Marijuana Cardholders’, being a registered patient is not always a valid defense to a marijuana DUI charge. Marijuana Possession and Minors

Just because a child is under the age of 18 does not mean that they cannot be arrested for having marijuana in their possession.
