New Mental Health Court Provides Therapeutic Services for Defendants on Probation

Pinal County has established a specialized court to cater to the needs of defendants with mental health problems; and to provide them with an alternative path to keep them out of the criminal justice system. The new Mental Health Treatment Court will provide therapeutic services post-sentencing for defendants placed on supervised probation. Generally, establishing this type of court increases public safety, reduces recidivism, and also, provides necessary care to those with mental disabilities.

To determine if a defendant is eligible for mental health court, he or she is screed for a mental illness and if that person is screened positive they are referred to the court by the Pinal County Attorney’s Office or the Pinal County probation department. Court staff then evaluates a defendant’s case to determine whether their situation is appropriate for the program.

The court will require eligible defendants to participate in an outpatient treatment program, while also checking in with the court on a weekly basis. If the defendant does not follow the treatment terms, the courts could revoke probation.
